DFC Accounting

End-User License Agreement

Effective September 4, 2026

This End-User License Agreement (“Agreement”) governs access to and use of the DFC Accounting web application (“Service”) provided by Desert Flying Club (“DFC,” “we,” “us,” or “our”).

1. Acceptance

By accessing or using the Service, you agree to this Agreement and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you are authorized to accept this Agreement for that organization.

2. Eligibility and authorized access

The Service is intended for DFC personnel, aircraft owners, instructors, contractors, and other users whom DFC authorizes. Access may require successful authentication through Flight Schedule Pro or another approved identity provider. You must provide accurate information, protect your account and authentication factors, and promptly report suspected unauthorized access.

3. License

Subject to this Agreement, DFC grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service through a supported web browser solely for authorized DFC accounting, aircraft, operational, and administrative activities. No ownership rights are transferred to you.

4. Acceptable use

You may use the Service only for lawful, authorized purposes. You may not:

  • access records, accounts, aircraft, companies, or documents you are not authorized to access;
  • share credentials or authentication codes, impersonate another person, or circumvent access controls;
  • interfere with the Service, introduce malicious code, probe for vulnerabilities without written authorization, or use automated methods that unreasonably burden the Service;
  • copy, reverse engineer, modify, distribute, sublicense, sell, or commercially exploit the Service except where applicable law expressly permits it; or
  • use data obtained through the Service for an unrelated purpose or in violation of law, club policy, or a third-party agreement.

5. Your responsibilities

You are responsible for reviewing entries, calculations, reports, leaseback statements, exports, and synchronized data before relying on or approving them. You must maintain any records and approvals required by DFC policy or law. The Service supports administrative accounting workflows; it is not legal, tax, insurance, aviation-safety, or professional accounting advice.

6. Data and connected services

The Service may exchange information with third-party services such as Flight Schedule Pro, Intuit QuickBooks Online, Google Drive, and payment or reporting portals. Your use of those services remains subject to their own terms and privacy practices. You authorize the Service to access and process information from a connected service only as necessary to provide the features you or an authorized administrator select.

You retain any rights you have in information you submit. You grant DFC permission to host, process, reproduce, and transmit that information as needed to operate, secure, back up, and improve the Service and to meet DFC’s legal and accounting obligations.

7. Intellectual property

The Service, including its software, design, documentation, and original content, is owned by DFC or its licensors and is protected by applicable intellectual-property laws. Third-party names and trademarks belong to their respective owners. Suggestions or feedback may be used by DFC without restriction or compensation.

8. Availability and changes

We may maintain, update, suspend, restrict, or discontinue any part of the Service. We do not promise uninterrupted or error-free operation. Features that depend on third parties may be unavailable when those services, credentials, permissions, or network connections are unavailable.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” DFC disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and reliability. Nothing in this Agreement excludes a warranty that cannot legally be excluded.

10. Limitation of liability

To the fullest extent permitted by law, DFC and its officers, volunteers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, or goodwill arising from the Service. DFC’s total liability arising from the Service will not exceed the greater of the amount you paid specifically for use of the Service during the preceding twelve months or one hundred U.S. dollars. These limits do not apply where prohibited by law.

11. Suspension and termination

DFC may suspend or terminate access when authorization ends, an account or connected service is disabled, this Agreement or club policy is violated, or suspension is reasonably necessary to protect DFC, its members, aircraft owners, or systems. Upon termination, your license ends immediately. Provisions that by their nature should survive will remain in effect.

12. Governing law

This Agreement is governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute not otherwise resolved must be brought in a court of competent jurisdiction located in Clark County, Nevada, except where applicable law requires otherwise.

13. Changes to this Agreement

We may update this Agreement. We will publish the revised version here and change the effective date. Continued use after an update becomes effective constitutes acceptance of the updated Agreement to the extent permitted by law.
